Document on the processing of personal data at YesPallet

Introduction

This privacy notice (hereinafter, “Privacy Policy”) sets forth the terms under which Expandiendo México, Sociedad Anónima de Capital Variable (YesPallet) will protect, safeguard, and process the personal data provided by the YesPallet user.

This is carried out in accordance with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties and its regulations, whose purpose is to protect personal data held by private entities in order to regulate its lawful, controlled, and informed processing, guaranteeing privacy and the right to information self-determination.

YesPallet is committed to protecting the personal and sensitive personal data provided by the user; when asked to fill out information fields for identification, it does so in compliance with the Terms and Conditions and this Privacy Policy.

1. Information Received

  • Addresses (warehouse and office).
  • Bank information for transactions.
  • Federal Taxpayer Registration.
  • Importers’ registry.
  • Customs Broker data.

As well as other specific data related to billing and logistics.

2. Management and Safekeeping of the Information Received

YesPallet and the website record in their database the information provided by the user for the purpose of providing a third-party product seller with the necessary information to send the merchandise selected by the user. In addition, the user’s non-sensitive personal data may be used by YesPallet to:

  1. Track the contracting process through the platform.
  2. Evaluate the user’s experience on the platform.
  3. Inform the user about services and promotions offered by YesPallet and third parties through the platform.

At any time, the user may restrict the use of their information through the mechanisms established by law.

YesPallet assures the user that, due to its professional ethics and in strict accordance with current legislation, it will not sell, assign, or distribute the information received without the user’s consent, unless such information is required by court order or if such consent is not required under applicable law.

3. Relationship of the Website with Third Parties

In the event that your personal data is transferred to third parties, whether national or international, such transfer will be carried out in accordance with the provisions of Articles 36 and 37 of the law, including authorities, collaborators, suppliers, distributors, and other companies or corporations that directly or indirectly provide services to YesPallet and/or the website.

6. Procedure for Exercising ARCO Rights

YesPallet and the website inform you that your personal information is protected by the processes set forth in the Federal Law on the Protection of Personal Data Held by Private Parties and its regulations. There are mechanisms to exercise the rights of Access, Rectification, Cancellation, or Objection (“ARCO Rights”). The procedure is described below:

Only the owner of the personal data may request to exercise these rights, as they are strictly personal rights.

A. Requirements for Submitting a Request to Exercise ARCO Rights
Such request must be sent to politicadeprivacidad@yespallet.com, including:

  • Name of the owner of the personal data.
  • Documents that prove the owner’s identity (e.g., official ID, passport, etc.).
  • If applicable, the name of the legal representative and documents proving their authority.
  • A means of receiving notifications.
  • A clear and accurate description of the personal data to be rectified, canceled, or objected to.
  • Any documents or information that make it easier to locate the personal data, if applicable.

B. Specific Description According to Each Right:
- Access: Indicate in which manner you prefer to receive the information.
- Rectification: Specify the modifications requested, providing supporting documents.
- Cancellation: The reasons for requesting the deletion of the data.
- Objection: The situation prompting the request to cease processing your data.

A copy of an official ID must be attached. If applicable, the representative’s authority may be proven by a public instrument or notarial documentation.

7. Deadlines and Procedure for Addressing ARCO Rights Requests

Once the request has been submitted and meets the stated requirements, the Data Controller shall:

  1. Within 20 business days from the day after the request is received, inform the owner whether or not the requested right is granted.
  2. If it is granted, the Data Controller must take the necessary actions within 15 business days from the day after the response is notified.

The aforementioned deadlines may be extended for an equal period when justified and communicated to the owner. The exercise of ARCO Rights will be simple and free of charge, except for reproduction, certification, or information shipping costs.
